REDEFININDO O PAPEL DOS JURADOS: UM DEBATE EM TORNO DO PROBLEMA DO CONCEITO DE ORDEM PÚBLICA E A NEGATIVA DO DIREITO DE RECORRER EM LIBERDADE NAS DECISÕES CONDENATÓRIAS DO TRIBUNAL DO JÚRI.

O DISCURSO ENTRE O CÁRCERE E A SUA SUPOSTA GRANDEZA SISTÊMICA.

Esse artigo espera contribuir para a compreensão da relação entre a religião e a política. Por meio da análise tipológica e do recurso metodológico da história oral temática elaboramos o seu ambiente teórico. Estudamos os jovens inseridos na Pastoral da Juventude do Meio Popular entre meados das décadas de 1980 e 1990, na região industrial de Belo Horizonte – Brasil. Estes jovens são representantes do grande movimento religioso conhecido como cristianismo da libertação de larga e profunda repercussão na história política (...) e religiosa da república brasileira da segunda metade do século XX. Nossa compreensão situa-se na passagem do catolicismo tradicional para o catolicismo internalizado experimentado por esses jovens e suas famílias no processo de migração das áreas rurais para a jovem área urbana. Vale dizer que os fragmentos de entrevistas citadas foram realizadas por nós para a pesquisa que deu vaga a esse artigo. Palavras-chaves : Juventude. Religião e política. For this purpose, we studied the young participants of the Youth Ministry of the "lower middle class" between the mid 1980s and 1990 in the industrial region of Belo Horizonte - Brazil. These young people represent a religious movement known as liberation Christianity, with profound repercussions in the political and religious history of the Brazilian republic of the second half of the twentieth century. The scope of this study lies in the transition from traditional Catholicism to the form of Catholicism internalized and experienced by these young people and their families in the process of migration from rural to urban areas. Fábio Alves dos Santos (1954-2013) cursou Pedagogia, Ciências Sociais e Teologia, era Especialista em Filosofia da Religião (PUC Minas), Advogado (PUC Minas) e Mestre em Direito Constitucional (UFMG). Lecionou na PUC Minas como professor de Cultura Religiosa e depois como professor no Curso de Direito, atuando principalmente no Serviço de Assistência Judiciária – SAJ, especialmente cuidado de causas populares como as da ASMARE (Associação dos Catadores de Papel, Papelão e Material Reaproveitável de Belo Horizonte), da Pastoral de Rua, (...) da Pastoral Carcerária, de movimentos de “Sem Casa”, de ocupações e tantos outros grupos. Fábio sofria de grave problema de visão há mais de 15 anos. Quase ficou cego depois de diversas cirurgias de miopia. Isso, porém, não o impedia de seguir seu constante compromisso com as lutas populares. Na última entrevista que concedeu, menos de um mês antes de sua morte (19 de outubro de 2013), depois de duro sofrimento de quase dois anos, no tratamento de um câncer no pâncreas, conta um pouco de sua vida, sua luta e sua percepção de várias realidades, especialmente da Igreja e da pastoral. Militante formado na Teologia da Libertação, de profunda espiritualidade, marcada por traços da religiosidade popular nordestina e comprometida com a libertação, Fábio Alves também buscou em sua vida abrir-se à teologia do pluralismo religioso, especialmente com o Santo Daime, em cuja tradição religiosa chegou a ser “fardado”, mantendo uma profunda atitude espiritual aberta ao diálogo inter-religioso. Sua primeira publicação foi “Começo de mundo novo: sofrimento, luta e vitória dos posseiros de Santana dos Frades”, Sergipe, numa versão popular em 1981 e outra pela Editora Vozes (1990). Fruto de sua dissertação de mestrado, publicou o livro “Direito Agrário: política fundiária no Brasil (1995). Em 2001 saiu seu último livro, uma coletânea de artigos publicados em diversos jornais: “Em defesa da vida”. Num artigo em Horizonte (2004), juntamente com o advogado, amigo e colega Prof. Cristiano de Melo Bastos, discutiu “A prática jurídica na missão da PUC Minas”. O artigo caracteriza a atual etapa do capitalismo a partir da centralidade dos mecanismos especulativos baseados no capital fictício e seus desdobramentos na totalidade da reprodução da vida. Identifica uma relação simbiótica entre reprodução do capital e administração pública como forma de recomposição do poder burguês nos últimos 40 anos. Para isso apresenta uma leitura da atual forma de relação entre Estado e Sociedade Civil e a conformação de novos blocos de poder hegemônicos. Nesta relação demonstra a existência de mecanismos (...) de descentralização do estado stricto sensu através da composição de parcerias público-privadas com empresas e Organizações Não-Governamentais da sociedade civil. Neste contexto questiona: quais os limites e potencialidades de fortalecimento da democracia? Inspirado na dialética negativa de Adorno, o artigo sugere a hipótese de emergência de uma nova forma de governança social oposta à governança hegemônica capitalista. Levando em consideração a resistência dos povos da América do Sul em seus territórios que constroem mecanismos próprios de poder e soberania para autodeterminarem seus destinos, reflete sobre a possibilidade de uma governança popular, como nomeada pelo filósofo Slavoj Zizek. Neste trabalho pretendemos analisar as propostas de construção social da realidade a partir da Teoria do Discurso, na perspectiva de Ernesto Laclau e da análise do discurso de Michel Foucault. Um discurso na perspectiva de Laclau ocorre pela articulação contingente de identidades, em torno de demandas hegemonizadas por uma das identidades que configuram o sentido da realidade. Esse fechamento de sentido é sempre inacabável e, portanto, é contingente e temporário. Já para Foucault o sentido do discurso não está preso às (...) suas condições de emergência passadas, e o que o define não é tanto um conjunto de aspectos comuns, mas um conjunto de regras de formação comuns e um marco institucional desde onde a autoridade do discurso emana. Aqui pretendemos expor os pressupostos epistemológicos dos dois autores e suas implicações na construção do político. (shrink)

Uma das questões mais interessantes do debate contemporâneo sobre a justiça, no âmbito da teoria política normativa, diz respeito sobre qual foco deveria ocupar a posição central de uma visão igualitarista: igualdade baseada em satisfação de necessidades básicas, bens primários como propõe Rawls, igualdade de recursos como defende Dworkin ou, como quer Amartya Sen, igualdade de capacidades? Com o que, afinal, os igualitaristas deveriam se preocupar? Este trabalho tem o objetivo de analisar criticamente essas três perspectivas.

The scientific community has debated the importance of “return” activities after ethnobiological studies. This issue has provoked debate because it touches on the ethics of research and the relationships with the people involved in these studies. This case study aimed to investigate community perception of an ethnobotany research project that was carried out in the semi-arid region of northeastern Brazil. Furthermore, we reported how the residents of this rural community felt about participating in the activities of “return” that arose from (...) the projects. Our findings demonstrate that “return” activities should be planned from the design phase of the research until its closure as a lifelong process that allows the communities involved to gradually take ownership of the information and actions that are being generated. Similarly, we argue that such activities must be negotiated with the people of the community so that they have decision-making power and autonomy to decide what is most relevant to their lives. The paper provides a qualified defence of Bruce Waller’s deductivist schema for a priori analogical arguments in ethics and law. One crucial qualification is that the schema represents analogical arguments as complexes composed of one deductive inference but also of one non-deductive subargument. Another important qualification is that the schema is informed by normative assumptions regarding the conditions that an analogical argument must satisfy in order for it to count as an optimal instance of its kind. Jesse Prinz (2006, 2007) claimed that emotions are necessary and sufficient for moral judgments. First of all, I clarify what this claim amounts to. The view that he labels emotionism will then be critically assessed. Prinz marshals empirical findings to defend a series of increasingly strong theses about how emotions are essential for moral judgments. I argue that the empirical support upon which his arguments are based is not only insufficient, but it even suggests otherwise, if properly interpreted. My criticism (...) is then extended to his sentimentalist theory, that accounts for how emotions are integrated into moral judgments. The central problem is that Prinz’s view fails to capture the rational aspect of moral evaluation. I make this failure explicit and defend that some version or other of neosentimentalism is a more promising route. (shrink)

The view that perceptual experience has representational content, or the content view, has recently been criticized by the defenders of the so-called object view. Part of the dispute, I claim here, is based on a lack of grasp of the notion of content. There is, however, a core of substantial disagreement. Once the substantial core is revealed, I aim to: (1) reject the arguments raised against the content view by Campbell (2002), Travis (2004), and Brewer (2006); (2) criticize Brewer’s (2006, (...) 2007, 2008, 2011) attempts to defend the object view; (3) refine Pautz’ (2007, 2008, 2009, 2010, 2011) arguments against the object view, which mainly resort to the fact that it cannot account for the grounding role of hallucinatory experiences; (4) and finally adjudicate in favor of the content view and against the overestimation of the naïve intuition. What is, after all, the famous method of Descartes? The brief and vague passages devoted to this subject in Descartes’ corpus have always puzzled his readers. In this paper, I investigate not only the two essays in which it is directly addressed (the Regulae ad Directionem Ingenii, and the Discours de la Méthode), but also his scientific works and correspondence. I finally advocate an interpretation that makes the best sense of his overt comments as well as of his actual scientific (...) practice. Contrary to widely accepted views, I argue that there are no substantial discontinuities in his understanding of his own method, or between his theory and practice. I claim, by contrast, that Descartes advocated a minimal method: a method that says little, but that, nonetheless, marks a revolutionary rupture with the existing forms of explanation. (shrink)

The thesis evaluates a contemporary debate concerning the very possibility of thinking about the world. In the first chapter, McDowell's critique of Davidson is presented, focusing on the coherentism defended by the latter. The critique of the myth of the given (as it appears in Sellars and Wittgenstein), as well as the necessity of a minimal empiricism (which McDowell finds in Quine and Kant), lead to an oscillation in contemporary thinking between two equally unsatisfactory ways of understanding the empirical content (...) of thought. In the second chapter, I defend Davidson's approach, focusing on his theory of interpretation and semantic externalism, as well as on the relation between causes and reasons. In the third chapter, the debate is analyzed in more detail. I criticize the anomalous monism, the way in which the boundaries between the conceptual and the non-conceptual are understood by Davidson, as well as the naturalized Platonism defended by McDowell. This thesis is mainly negative, and it concludes by revealing problems in both positions under evaluation. (shrink)

El artículo analiza la interpretación que Adorno hace de Kafka en Apuntes sobre Kafka, concentrando la atención en la consideración sobre Kafka como un escritor ilustrado que critica la Ilustración, con el fin de determinar si dicha afirmación es o no coherente con la teoría adorniana. Para esto, se compara la lectura que Adorno y Kafka hacen del episodio del canto de las sirenas de la Odisea y se analizan las diferencias existentes entre las dos interpretaciones. Gracias a ello podemos (...) concluir, parcialmente en contra de Adorno, que Kafka es un crítico de la Ilustración, aunque no es un escritor ilustrado. (shrink)

O PROBLEMA DO LICENCIAMENTO DE GRANDES EMPREENDIMENTOS PRIVADOS EM FACE DO DIREITO URBANÍSTICO: ANÁLISE DE UM CASO EMBLEMÁTICO NA PERIFERIA DA REGIÃO METROPOLITANA DO RIO DE JANEIRO.

In this paper I focus on the question of whether nanotechnology is giving rise to new ethical problems rather than merely to new instances of old ethical problems. Firstly, I demonstrate how important it is to make a general distinction between new ethical problems and new instances of old problems. Secondly, I propose one possible way of interpreting the distinction and offer a definition of a “new ethical problem”. Thirdly, I examine whether there is good reason to claim that nanotechnology (...) is giving or will give rise to new ethical problems. My conclusion is that there are no new ethical problems in nanotechnology but merely new occurrences of certain well-known types of ethical problems. Fourthly, I consider three arguments by van de Poel (NanoEthics 2:25–28, 2008) which contradict my conclusion. I argue that my negative conclusion is consistent with the claim that certain ethical issues arising in nanotechnology may require new normative standards or new analytical tools. I conclude that it is likely that a number of ethical issues arising in nanotechnology will have a considerable impact on our ethical theories and values – and that ethical reflection on nanotechnology will be one of the mother lodes of future ethical research – in spite of the fact that no ethical problem in nanoethics will actually be “new”. O presente artigo trata da esquerda católica paranaense a partir do arquivo de documentos do Serviço Nacional de Informações (SNI-PR), da agência de Curitiba. O objetivo geral foi compreender criticamente, servindo-se da perspectiva de Otto Maduro, as expressões político-ideológicas descritas, anexadas e julgadas nos relatórios dos agentes do SNI-PR sobre a esquerda católica do interior do Paraná, no período de abertura política da ditadura militar. Por meio da pesquisa documental qualitativa de tipo exploratória, composta pelos diferentes registros dos agentes do (...) SNI-PR, foram identificadas as ações de religiosos do interior do Paraná que se constituíram alvo de vigilância e perseguição pelo aparato estatal da ditadura militar no período de abertura política. Destaca-se a importância de estudos sobre a esquerda católica sob a vigilância e o silenciamento nas regiões interioranas, evidenciando que o alcance do aparato estatal repressivo da ditadura não se limitou às regiões metropolitanas ou com maior densidade populacional. Ainda, o acesso aos arquivos inéditos permitiu tratar o tema vinculado ao campo religioso como um produto da dinâmica dos conflitos sociais na sociedade brasileira, com a ação religiosa limitada e orientada por tais conflitos, mas possuindo autonomia relativa sobre estes. The purpose of Machine Ethics is to develop autonomous technologies that are able to manage not just the technical aspects of a tasks, but also the ethical ones. As a consequence, the notion of Artificial Moral Agent (AMA) has become a fundamental element of the discussion. Its meaning, however, remains rather unclear. Depending on the author or the context, the same expression stands for essentially different concepts. This casts a suspicious light on the philosophical significance of Machine Ethics. In particular, (...) the risk arises of discarding Machine Ethics as a whole on the basis of accusations that, however, apply exclusively to one specific understanding of what AMAs are – but not to other, more adequate and convincing conceptualisations. To avoid this pitfall, this essay tries to elaborate a philosophically sound interpretation of AMAs and to sketch its primary component, i.e., the notion of functional ethics. (shrink)

This short paper offers a preliminary inquiry into the impacts of driving automation on personal autonomy. Personal autonomy is a key ethical value in western culture, and one that buttresses fundamental components of the moral life such as the exercise of responsible behaviour and the full enjoyment of human dignity. Driving automation simultaneously enhances and constrains it in significant ways. Hence, its moral profile with reference to the value of personal autonomy is uncertain. Ethical analysis shows that such uncertainty is (...) due not just to the complexity of the technology, but also to the multifaceted normative profile of personal autonomy, which offers reasons to support both conditional and full driving automation. The paper sheds light on this duplicity, underlines the challenges this poses to the ethics of driving automation, and advocates for further research aimed at providing practitioners with more fine-grained guidelines on such a delicate issue. Our investigation on Hilary Putnam’s internal realist perspective(internalism) traces parallels and identifies differences between Putnam’s ideasand their antipodes: metaphysical realist (externalism) and radical relativist. Ourresearch has focused upon the contemporary debate in which it is inserted, par-ticularly, upon the challenge that radical relativism to impose on contemporaryepistemology. Such challenge will not be surmounted through classical project tofind absolute certainties. The history of science to point out that theories are notnets that to catch the reality as it is in itself. But (...) this do not to imply that our viewof knowledge are only determined for contingent aspects. ABSTRACT: Beginning with the analysis of the Mitleid, understood as the metaphysical foundation of Arthur Schopenhauer’s ethics, this contribution aims to investigate the ‘pathological criterion’ as instituting a new direction in contemporary ethics, in order to develop and actualize it in the perspective of a patient-oriented ethics.

This chapter proposes a corpus-based investigation and a semantic analysis of the Italian word "altro" ‘other’, focusing on two values of "altro" identified in the previous literature: difference (D-interpretation) and increment along a scale (M-interpretation). In syntax-based studies, focused on cardinal noun phrases, the two values have been related to distinct syntactic positions occupied by "altro" within the NP’s extended projection (Cinque 2015, Kayne 2021): a lower position, associated with the D-interpretation (altro N = ‘other kind of N’), and a (...) higher position, associated with the M-interpretation (altri n N = ‘n more tokens of N’). Conversely, discourse-based studies assume that the two values are due to a lexical ambiguity of "altro", with the D-interpretation being triggered by a discourse relation of contrast and the M-interpretation by an additive relation (Gianollo and Mauri 2020). We examine the distribution of the two values in the CORIS corpus of contemporary Italian (Rossini Favretti et al. 2002) and consider the question of whether they are equally basic interpretations or one of them is derivable from the other. The analysis we propose relies on the idea that the semantic core of "altro" is the relation of non-identity. The D-interpretation and M-interpretation result from the interaction between this semantic core and features of the larger discourse context, with additive and contrastive features playing a major role. Non-identity is introduced in the semantic representation of the sentence irrespective of the syntactic position of "altro", while discourse context—including lexical properties of the noun—determines at what ontological level (whether type or token) non-identity is evaluated. The analysis is cast in the framework of Segmented Discourse Representation Theory (SDRT; Asher and Lascarides 2003), which allows a modular representation of the separate contributions of "altro" and discourse structure. This paper is concerned with the reappraisal of Husserl’s ontology and epistemology, sketched in book one of Ideen. The main issue is Husserl’s theory of essence and essential insight. I present the fundamental distinction between facts and essences, and, over and above it, Husserl’s defense of an a priori knowledge based on essential insight as well as his partition of the whole realm of a priori knowledge into a formal set of material, regional ontologies. I will show how the theory (...) of essential insight presented in Ideen gives rise to several criticisms, namely those made by Neo-Kantians, like Rickert and Natorp. In the last part, I will show how the mathematical concept of an invariant under a group of variations was the leading case for Husserl’s mature notion of eidetic insight. (shrink)

I discuss, from a phenomenological point of view, the distinction between judgments and norms. I stress the limits of the husserlian canonical analysis in order to rightly account for the sense and content of normative intentionality. Based on some Kelsian insights, I draw a clear distinction between judgments and norms, criticizing some classical trends coming from Husserl himself that consider norms as a kind of intentionality founded upon objectifying acts. However, taking distance from Kelsen, Kaufmann, and Cossio, I stress that (...) the ought-proposition (Sollsatz) cannot be a good rendering of the sense-content of norms, based on the phenomenological distinction between the intentional matter and the quality of intentional acts. Finally, I propose my own account based on the concept of ‘ductive force’. I stress that the ductive force of norms cannot be identified witb simple coercion. [ show that there is, even inside the juridical sphere, a variety of ductive forces, going from sheer coercion to council and recommendation. To end, I stress the centrality of the concept of “ductive force” for a phenomenology of the social world. (shrink)

I offer an outline of an integrated phenomenological analysis of free fantasy and of fictional worlds. My main concern amounts to stress the scissions entailed in free fantasy and in the consciousness of fictional objects: a scission of the I, and a scission of the experience. Firstly, I offer a somewhat new characterization of the presence of the objects of free fantasy, which disconnects any possible relationship of those objects with a real perception as the leading form of an originally (...) giving consciousness. My leading example is daydream. Secondly, I take the Husserlian analysis of neutralization as a conceptual tool to explain the consciousness of fictional worlds, against a new tendency for interpreting these worlds in light of the concept of “possible world”. The two approaches converge to a twofold characterization of the mode of being of fictions and of the modality of presence of the objects of fantasy. (shrink)

Mediante análise da proposta curricular do Estado de Minas Gerais para o ensino de Filosofia e do pressuposto, sugerido por Isaiah Berlin (1909-1997), de que no coração da filosofia política reside o problema da obediência, o artigo discute de que modo a identificação e a formulação de um problema filosófico pode remeter professores e estudantes a outras questões, temas e conceitos filosóficos elaborados historicamente.

O presente artigo tem o objetivo de analisar a recepção da obra de Arendt a partir da categoria biopolítica. A categoria biopolítica instalou-se no centro do debate ético, político-filosófico contemporâneo, especialmente, após a requalificação de tal conceito dada por Foucault. Trata-se de mostrar que o termo biopolítica é anterior a Foucault, mas só com ele tal categoria adquiriu dimensão crítico-filosófica, considerando-o, no entanto, que é com Agamben que se dá a potencialização do debate acerca do tema biopolítica, exatamente, porque ele (...) inclui as reflexões de Arendt na trilha que leva à compreensão da naturalização da vida humana nas atuais configurações da sociedade. Assim, não obstante a inexistência de diálogo entre Arendt e Foucault, tenta-se analisar como, de alguma forma, Arendt, através da categoria campo de concentração e da centralidade da atividade do trabalho (labor), antecede e possibilita, no mundo moderno, a consistência analítica que a biopolítica passou a ter hodiernamente, argumentando que, apesar de a autora não usar o sintagma biopolítica, de alguma forma, o conceito, o campo de significação do termo, encontra-se efetivamente presente na obra de Arendt. Este estudo teve como objetivo investigar a qualidade de vida em pessoas com câncer que buscam assistência em casas de apoio. A amostra foi composta por mulheres (82,5%) e homens (17,5%), (N=57). The COVID-19 pandemic challenged countries, regions, schools, and individuals. School closures due to lockdowns forced changes in the teaching practices and the learning support provided to children at home. This study aimed to provide insights on the changes between the first and the second lockdowns in Portugal, concerning remote teaching practices and family support to children's education. A self-report questionnaire was filled by 144 parents of third grade students. The results show that, between the two lockdowns, there was a significant (...) decrease in the amount of support provided at home to school assignments and activities, as well as in the amount of time spent by students in TV broadcasted lessons and in reading training supported by the family. Inversely, families reported a significant increase in the amount of time spent by students in independent reading activities and in the time spent in training reading guided by teachers. The number of synchronous lessons with a teacher and the number of times students trained reading during a synchronous lesson also increased in the second lockdown. Additionally, in the second lockdown, parents perceived synchronous lessons to be more effective at improving their child's reading skills and perceived themselves as more capable of supporting their child in reading acquisition. O republicanismo é constituído de diversas matrizes, entre elas a matriz inglesa e a matriz francesa às quais vinculam-se os pensadores modernos Algernon Sidney e Jean-Jacques Rousseau respectivamente. Buscando uma provável relação teórica entre o autor inglês e o pensador de Genebra quanto à tradição republicana, o presente artigo promoverá um exame e quiçá uma reflexão acerca do “espírito republicano” em Sidney e Rousseau assinalando as possíveis afinidades e divergências entre eles, embora sejam vinculações a diferentes matrizes. Para tanto, indaga-se: (...) é possível constatar alguma relação teórica entre esses dois pensadores? Preliminarmente, julgamos que seja possível, sim, realizar tal constatação a partir de uma análise do “espírito republicano” presente sob as penas desses pensadores. (shrink)

Durante o período fascista, a imprensa era considerada um instrumento fundamental para a criação do “homem novo” italiano e, da mesma forma, para a difusão dos ideais do fascismo fora da Itália. Através de várias agências governamentais, o governo italiano promovia a circulação de artigos e de material de propaganda pelo mundo, nos mais diversos idiomas. Do mesmo modo, a imprensa em língua italiana, publicada nos vários países de imigração italiana, servia de instrumento para essa mesma divulgação. O objetivo dessa (...) comunicação é apresentar os canais de reprodução jornalística, tanto em língua italiana como em outros idiomas, que conectavam a Itália com os países da América Latina. Em última instância, o objetivo é verificar como a imprensa e os jornalistas foram fundamentais na criação de uma rede transnacional fascista entre a Itália, a Europa e a América Latina no período considerado.
